PÓLIZA DE PRIVACIDAD

THINK-E ENGLISH COURSES INC, protege sus datos personales para evitar el daño, pérdida, destrucción, robo, extravío, alteración, así como el tratamiento no autorizado de sus datos personales y pone a su disposición el presente Aviso de Privacidad, a fin de que conozca sus prácticas al obtener, usar, almacenar y, en general, raptar sus datos personales.
1. Responsable del tratamiento de datos personales. THINK-E ENGLISH COURSES INC (en lo sucesivo “La Responsable”), con domicilio en 259 NE 51st Street, 2, Miami, FL 33137.
2. Datos Personales que pudieran recabarse. Los Datos Personales que Usted nos proporcione libre y voluntariamente, de manera enunciativa más no limitativa pueden ser los siguientes:
– Datos de identificación, tales como: nombre, domicilio particular, lugar y fecha de nacimiento, estado civil, ocupación, escolaridad, número de seguro social, número de teléfono, fijo o móvil, fax, correo electrónico.
– Datos laborales, tales como: cargo, domicilio laboral, correo electrónico, número de teléfono, fijo o móvil y fax.
– Datos de facturación, tales como: entidad a la que se hará el cargo, domicilio fiscal, numero de seguridad social, EIN.
– Datos financieros, tales como: información de cuentas bancarias, políticas de pago, datos de contacto de áreas cuentas por pagar y cuentas por cobrar.
– Datos del negocio, tales como: domicilio de establecimientos, de plantas manufactureras, oficinas de ventas, requerimientos y necesidades de productos, precios de productos y servicios, datos de contacto de áreas de ventas.
La responsable podrá recabar sus datos personales de las siguientes formas: cuando usted nos los proporciona directamente, cuando obtenemos información a través de otras fuentes tales como los directorios telefónicos, referencias de otras empresas o particulares, bases de datos públicas de cualquier entidad o dependencia pública o privada, entre otras.

REDES SOCIALES

Las redes sociales (tales como Facebook® y Twitter®, entre otras) constituyen una plataforma de comunicación y de interconexión entre plataformas digitales de los distintos usuarios, son ajenas a LA EMPRESA y, por lo tanto, no se encuentran bajo su responsabilidad. La información que Usted proporcione dentro de redes sociales en las que La Responsable participa como usuario, no constituye ni forma parte de los Datos Personales sujetos a la protección de este Aviso de Privacidad, siendo responsabilidad de la empresa prestadora de esa plataforma y de quien lo publica. En la recolección y tratamiento de datos personales que usted nos proporcione, cumplimos todos los siguientes principios: licitud, calidad, consentimiento, información, finalidad, lealtad, proporcionalidad y responsabilidad. La veracidad de la información que proporcione queda bajo su responsabilidad, por lo que “La Responsable” en ningún momento responderá por la autenticidad de la misma.
IV. Transferencia de datos personales. La Responsable recabará sus Datos Personales sin fines de divulgación o utilización comercial, y solamente los usarán para los siguientes fines:
– Cobro, facturación, pago y transacciones: con el fin de realizar los cargos económicos.
– Evaluar la calidad de nuestros productos y servicios.
– Formalizar en contratos u otros documentos la relación que se genere con usted.
– Darle a conocer la información comercial de LA EMPRESA, entre la que se destaca la relacionada con promociones, información de nuevos productos, cambios en nuestros productos, realizar estudios internos sobre hábitos de consumo y cualquier otro promocional o cuestión relacionada con los productos y/o servicios que forman parte del concepto comercialmente de “La Responsable”.
– Entrega de productos y cumplimiento de obligaciones derivado de nuestra relación comercial con Usted.
– Darlo de alta en nuestros sistemas como proveedor y/o cliente ya sea en sus modalidades eventual o permanente.
Sus datos personales serán guardados bajo la más estricta confidencialidad y no podrán utilizarse para finalidades distintas a las antes mencionadas salvo que exista un cambio al presente Aviso de Privacidad y se obtenga su conformidad expresa con dicho cambio. Una vez que se cumpla la finalidad del tratamiento de sus datos personales, éstos serán bloqueados con el único propósito de determinar posibles responsabilidades en relación con su tratamiento, hasta el plazo de prescripción legal o contractual de éstas. Durante dicho periodo, los datos personales no podrán ser objeto de tratamiento y transcurrido éste, se procederá a su cancelación en la base de datos que corresponde.
IV. Transferencia de datos personales. La Responsable no, cede o transfiere datos personales sin que medie el previo consentimiento del titular de los datos.
V. Medidas de Seguridad/Límites al acceso. La Responsable ha adoptado las medidas de seguridad técnicas, administrativas y físicas necesarias y suficientes para proteger sus datos personales contra daño, pérdida, alteración, destrucción o el uso, acceso o tratamiento no autorizados. Los datos personales son salvaguardados en bases de datos y equipos de cómputo que cuentan con la seguridad necesaria para prevenir fugas de información. Controles de acceso físico y lógico, controles ambientales, sistemas de protección anti intrusos (IPS, Firewall), herramientas de protección antivirus y filtrado web son algunas de las herramientas utilizadas para mantener la seguridad de los datos en los sistemas de información de La Responsable. Las herramientas de seguridad informática mencionadas en el párrafo anterior están apoyadas por una política interna de seguridad de la información que explica a los empleados de La Responsable las consideraciones de seguridad que deben tomar en cuenta al utilizar un sistema informático y es reforzada constantemente. Sin embargo, es claro que ninguna transmisión de datos por Internet es completamente segura y, por ende, La Responsable no puede garantizar que el tratamiento de datos personales estará libre de todo daño, pérdida, alteración, destrucción o el uso, acceso o tratamiento no autorizados. Únicamente el personal autorizado que ha cumplido y observado los correspondientes requisitos de confidencialidad, podrá participar en el tratamiento de sus datos personales. Por ello, se hace de su conocimiento las opciones que usted tiene para solicitar la limitación del uso o divulgación de sus datos personales, materia de este Aviso de Privacidad:
– Por escrito enviado al Encargado del Tratamiento de Datos Personales, en el domicilio señalado en el presente documento o vía correo electrónico dirigido a la dirección info@think-e.us.
– Vía telefónica con el Encargado del Tratamiento de Datos Personales al teléfono (786) 405-3224. VI. Derechos que le corresponden al titular de Datos Personales. Como titular de datos personales, Usted puede ejercitar ante el Encargado de Protección de Datos Personales, los derechos de Acceso, Rectificación, Cancelación y Oposición. Asimismo, Usted puede revocar, en todo momento, el consentimiento que haya otorgado y que fuere necesario para el tratamiento de sus Datos Personales, así como limitar el uso o divulgación de los mismos. La solicitud para ejercer los derechos deberá contener y acompañar la información y documentos siguientes:
– El nombre y domicilio del titular u otro medio para comunicarle la respuesta a su solicitud.
– Los documentos que acrediten su identidad o, en su caso, la representación legal del titular.
– La descripción clara y precisa de los datos personales respecto de los que se busca ejercer alguno de los derechos.
– Cualquier otro elemento o documento que facilite la localización de los datos personales, así como cualquier otro documento que exija la legislación vigente al momento de la presentación de la solicitud.
En caso de que no desee recibir correos electrónicos con la actualización de los productos y/o servicios que comercializa La Responsable, así como recordatorios referentes al cumplimiento de ciertas obligaciones que apliquen a Usted por su actividad empresarial, puede enviarnos su solicitud a la dirección electrónica de la encargada del Tratamiento de Datos Personales designado por La Responsable. La Responsable no estará obligada a cancelar sus Datos Personales cuando se trate de las siguientes:
– que se refiera a las partes de un contrato privado, social o administrativo y sean necesarios para su desarrollo y cumplimiento;
– deban ser tratados por disposición legal;
– se obstaculice actuaciones judiciales o administrativas vinculadas a obligaciones fiscales, la investigación y persecución de delitos o la actualización de sanciones administrativas;
– sean necesarios para proteger los intereses jurídicamente tutelados del titular;
– sean necesarios para realizar una acción en función del interés público.
VII. Revocación. El titular de los Datos Personales podrá revocar su consentimiento para el tratamiento de Datos Personales en cualquier momento, debiendo, únicamente para tales efectos, enviar una solicitud por escrito al Encargado de los Datos Personales, ya sea por mensajería al domicilio o al correo electrónico mencionado en el presente Aviso de Privacidad.
Tendremos un plazo máximo de 20 días hábiles para informarle sobre la procedencia de la misma y si resulta procedente, se haga efectiva la misma dentro de los quince días hábiles siguientes a la fecha en que se comunica la respuesta al correo electrónico que nos proporcione para tales efectos.
VIII. Modificaciones de aviso de privacidad. La Responsable se reserva el derecho de efectuar en cualquier momento modificaciones o actualizaciones al presente aviso de privacidad, para la atención de novedades legislativas, políticas internas o nuevos requerimientos para la prestación y ofrecimiento de nuestros servicios. Estas modificaciones estarán disponibles al público y se las haremos llegar al último correo electrónico que nos haya proporcionado. No seremos responsables si Usted no recibe la notificación de cambio en el Aviso de Privacidad si existiere algún problema con su cuenta de correo electrónico o de transmisión de datos por internet.

Between THINK-E ENGLISH COURSES INC, (“the Company” or “Think-E”) with address at 259 NE 51ST ST APT 2, MIAMI, FL 33137, and the client identified above, hereinafter the (“Client”), who enter into the following License Agreement for (“the site” or “the service”).

1. Purpose
1.1 Object – Use Licence The purpose of this Agreement is the purchase and sale of a use license in Integral English Language Learning System Think-e®, hereinafter (“the System”), whose characteristics and content are detailed in this Agreement and which has been carefully elaborated for the autonomous learning of the English language. The Client is granted permission to a terminable, non-transferable license for personal non-commercial transitory viewing only. This is the grant of a license, not a transfer of title. Any physical materials sent to the client as part of the System are a gift. Once the license to the System is granted, the Client may give Notice of cancellation to the Company in writing within three working days after receiving the confirmation.
1.2 Description.
 Only one (1) Think-e® Integrated English Language Learning System described and indicated above will be delivered.
2. Usage. The Think-e® Integrated English Language Learning System shall be used in accordance with the instructions given for the use of the Think-e® Integrated English Language Learning System.
2.1 Content. The Client shall be entitled to receive the virtual practices for the use of the System, performing a maximum of four (4) weekly practices distributed in a maximum of two (2) Think-e® Learning Loops. Each Think-e® Learning Loop has two spaces of 50 minutes each, distributed in 2 sessions of twenty-five (25) minutes in the E-Lab (individual practices) and one (1) session of 50 minutes in the E-Talk (Group practices of 1 to 15 people).
2.2 Completion. The System has a maximum duration of nineteen (19) months. Essential with a duration of 1 month. Progressive 1 and 2 with a duration of 8 months. Evolution with a duration of 5 months and Vantage with a duration of 5 months.
2.3 Schedules. The schedules of Think-e® for the use of the System are from Monday to Friday from 7:00 to 10:00 and from 17:00 to 22:00 and from 8:00 to 16:00 hours on Saturdays upon request of the Client to the Company with 24 hours of anticipation.
2.4 Benefit. The Client once they comply with the requirements described in this Agreement and satisfactorily completes the levels (essential, progressive 1 and 2, evolution and Vantage), will be able to take the final Think-e® exam and receive a certificate of recognition of the skills and achievements up to the level reached in the language.
2.5 Support. The System and its contents have been developed and reviewed by qualified persons. In case of any inconvenience with the online access to activate the licenses of the System, the Company will provide the necessary support to restore it or generate a new one, as long as the causes are not attributable or due to misuse by the Client.
Payment. The total price and form of payment of the present sale is the amount stipulated in this Agreement.
2.6 Terms of Payment. The Client delivers at the time of the signature of this Agreement to the Company, the amount described as first payment or total payment according to the payment option chosen; therefore, this Agreement duly signed, serves as the most comprehensive receipt that corresponds in law with respect to such amount. In the event that the Client does not make the payment of the monthly installments in a timely manner, a penalty will be generated by way of late interest amounting to two percent of the total overdue debt. Furthermore, the non-timely payment of the monthly payments agreed in the present Agreement will entitle the Company to collect all the outstanding monthly payments as if they were due and may charge the Client all the collection expenses and corresponding fees. Likewise, it shall entitle the Company to suspend the delivery of the services that are part of the System.
2.7 Means of payment. The monthly payments will be paid according to the means authorized by the Company, consult them at www.think-e.us.
2.8 Effect of non-attendance. If the Client opted to pay the System in monthly installments, said licenses will be delivered once the Company authorizes the credit against the signature of the respective receipt by the Client. If the agreed payment is by monthly installments, these shall be monthly and consecutive as established in this Agreement. The non-use or non-attendance to the experiential practices of the learning System by the Client does NOT affect the obligation of payment of the monthly payments and the total price agreed in this Agreement. In the same way, the Company is obliged to deliver and provide the service of the System for the time and conditions indicated above.
2.9 Remedies for non-payment. The Client authorizes the Company in a clear, express, concrete, and explicit manner or whoever in the future holds the status of creditor of the monetary obligation that the Client has acquired as a user of the agreed System, to make adverse reports in all credit bureaus should the Client delay more than sixty (60) days in the payment of the obligations, which are stated in the present Agreement. Furthermore, the Client understands and accepts that in case of having chosen the option to pay the price in monthly installments, the present Agreement is subject to the Company verifying the information provided by the Client and the payment capacity of the Client; acts that from this moment the Client expressly authorizes the Company to carry out investigations on the credit behavior of the Client with the credit bureaus, during the following three years or during the time it maintains commercial and/or legal relationship with the Company. Likewise, the Client declares that they know the nature and scope of the information that will be requested as well as the use that will be made of such information, and that the Company will be able to make periodic inquiries of the credit history of the Client, during the following three years or during the time they maintain a commercial and/or legal relationship.
3. Without Coercion or Duress. The Client and the Company expressly state that in the celebration of this Agreement, there is no error or violence that could vitiate their consent by virtue of having verified the accuracy of their statements and expressed their will freely.
4. Intellectual Property. The Company declares that it has the authorization to commercialize the licenses of each one of the items of National Geographic Learning; e-books, online Workbook, MyELT access platform, which are part of the System and that this Agreement, grants the right to the Client to use such items during the term of this Agreement and subject to the conditions of this Agreement. The Client agrees that national and international intellectual property laws protect the System. The Client agrees not to copy, publish, share the content and documents of the Service. The Client agrees that the licenses are for personal and non-transferable use and that they will not lease, sell, sublicense, distribute, share the content or any copy or portion thereof to any person without prior written authorization from the Company. The Client is responsible for maintaining the confidentiality of its license to access the Client, such as its user name and password. For this reason, the Client must notify the Company of any unauthorized use of its account.
4.1 Trademark. The trademark and other advertising signs are exclusive rights of the Company.
4.2 Non-reproduction. The Client understands that the Service transferred to him by this Agreement is duly protected by Copyrights law. Accordingly, the Client is prohibited from exploiting it commercially and reproducing it partially or totally by any means.
5. Cancellation. After the activation of the licenses of the System and up to a maximum term of two months, if the Client voluntarily and unilaterally decides not to continue with the development of the System, and the Company granted a payment plan, they MUST pay the value corresponding to twenty (20) percent of the total price of the Think-e® system, without taking into account what has been paid up to the date of said request. This is due to the costs incurred by the Company in activating the licenses, franchise rights, royalties, commercialization, and administration of the System. The Client recognizes this does not represent an unjustified imbalance to their detriment. After the maximum term described in provisions, cancellations are not accepted, and the totality of the contract price must be paid. If the Client made their payments with promotions that derive from financial services expenses, financial such expenditures shall be borne by the Client. For the Client to be able to cancel this Agreement according to the provisions of this clause, they must be up to date in the payment of the monthly installments.
6. Technological requirements. To know and consult the minimum technical requirements for the operation of the System, consult www.think-e.us
7. Customer Service. Your opinions, requests or complaints are very important to us. If you wish to contact us, please visit www.think-e.us.
8. Incorporation. The offer, the brochure, the reaffirmation to the Agreement, the delivery receipt, and other advertising material are an integral part of this Agreement.
9. Termination. The Client expressly authorizes the Company to assign this Agreement at any time.
10. Warranty. The Client will have a written letter of guarantee, which guarantees the learning of the English language with the integral learning system Think-e®. Consult terms and conditions at www.think-e.us.
10.1      Certification. The Client acknowledges that the free presentation of the TOEFL ITP test may be done once (1) the development of the System has been completed, (2) they are up to date in their monthly payments and (3) itis within the terms of this Agreement. The Client also acknowledges that the custody, evaluation, and issuance of the test result is administered directly by ETS (Educational Testing Service) under the policies and requirements that frame the presentation of TOEFL ITP tests.
10.2 Means, not results. The present Agreement is of a commercial nature. Therefore, it is understood between the parties that the obligations of the Company are obligations of means and not of results. The responsibility of the Company is to make available to the Client the suitable personnel to carry out the counseling and practices on the Think-e® English language learning system. The results obtained by the Client depend on their discipline and follow-though with the instructions given.
11. Divisibility. If any term or provision of this Agreement is determined to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.
12. Governing Law. This Agreement is governed by and construed in accordance with the laws of the State of Florida without giving effect to any choice or conflict of law provision or rule. Each Party irrevocably submits to the exclusive jurisdiction and venue of the federal and state courts located in Miami-Dade County, Florida, in any suit, action, or legal proceeding arising out of or based upon this Agreement.
13. Dispute Resolution. If a dispute arises relating to this Agreement, or the alleged breach thereof, and if the dispute is not resolved by negotiation between the Parties, the Parties agree to first attempt in good faith to resolve the dispute by good-faith negotiation between the Parties within 72 hours after Notice to the other Party of the dispute. If good faith negotiation fails, the Parties agree that the next attempt to resolve the dispute through mediation shall be scheduled within 14 days after notification of the dispute by either Party. The Parties agree to mediate the dispute by participating in at least one-half day of mediation before resorting to arbitration, litigation, or other dispute resolution procedure. If the Parties cannot agree on a mediator, the Company will select a mediator. The parties agree to maintain the confidentiality of the mediation process on terms acceptable to the mediator and the mediation service provider. The parties agree to split the cost of hiring a mediator 50/50.

Privacy Policy

THINK-E ENGLISH COURSES INC protects your personal data to prevent damage, loss, destruction, theft, loss, alteration, as well as unauthorized processing of your personal data and makes available this Privacy Notice to make known its procedures to obtain, use, store and, in general, capture your personal data.

– Identification data: name, home address, place and date of birth, marital status, occupation, education, social security number, telephone number, landline or mobile, fax, email.
– Employment data, position, work address, email, telephone number, landline or cell phone number, and fax.
– Billing data, entity to be charged, tax address, social security number, EIN.
– Financial data, bank account information, payment policies, contact information for accounts payable and accounts receivable areas.
– Business data, address of establishments, manufacturing plants, sales offices, product requirements and needs, prices of products and services, contact details of sales areas.
The Controller may collect your personal data in the following ways: when you provide it to us directly, when we obtain information through other sources such as telephone directories, references from other companies or individuals, public databases of any entity, or public or private agency, among others.
SOCIAL NETWORKS.
Social networks (such as Facebook® and Twitter®, among others) are a platform for communication and interconnection between digital platforms of different users, are unrelated to the Controller, and therefore, are not under its responsibility. The information you provide within social networks in which the Controller participates as a user does not constitute or form part of the Personal Data subject to the protection of this Privacy Notice, being the responsibility of the Company providing that platform and the one who publishes it. In collecting and processing the personal data you provide us, we comply with all the following principles: legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility. The veracity of the information you provide is under your responsibility so that the Controller at no time is liable for the authenticity of the same.
III. Purposes of Personal Data Processing.
The Controller Party will collect your Personal Data without the purpose of disclosure or commercial use and will only use it for the following purposes:
– Collection, invoicing, payment, and transactions to execute transactions.
– To evaluate the quality of our products and services.
– To formalize in contracts or other documents the relationship created with you.
– To let you know the commercial information of the Controller, among which stands out the one related to promotions, information of new products, changes in our products, to carry out internal studies on consumption habits and any other promotional or question related to the products and services that are part of the commercial concept of Controller.
– Delivery of products and fulfillment of obligations derived from our commercial relationship with you.
– To register you in our systems as a supplier and customer either in its eventual or permanent modalities.
Your personal data will be kept under the strictest confidentiality. They may not be used for purposes other than those mentioned above unless there is a change to this Privacy Notice and your express consent to such change is obtained. Once the purpose of processing your personal data is fulfilled, your data will be blocked except for the sole purpose of determining possible liabilities concerning the processing until the term of legal or contractual prescription of these. During such period, the personal data may not be processed, and after such period, they will be deleted in the corresponding database.
IV. Transfer of Personal Data. The Controller does not assign or transfer personal data without the prior consent of the owner of the data.
V. Security Measures/Limits to Access. The Controller has adopted the necessary and sufficient technical, administrative, and physical security measures to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access, or processing. Personal data are safeguarded in databases and computer equipment that have the necessary security to prevent information leakage. Physical and logical access controls, environmental controls, anti-intrusion protection systems (IPS, Firewall), antivirus protection tools, and web filtering are used to maintain data security in the information systems of the Controller. The IT security tools mentioned in the previous paragraph are supported by an internal information security policy that explains to the Controller Party’s employees the security considerations to be taken into account when using an IT system and is constantly reinforced. However, no data transmission over the Internet is entirely secure. Therefore, the Data Controller cannot guarantee that the processing of personal data will be free from any damage, loss, alteration, destruction or unauthorized use, access, or access processing. Only authorized personnel who have complied and observed the corresponding confidentiality requirements may participate in processing your personal data. Therefore, we inform you of the options you have to request the limitation of the use or disclosure of your personal data, subject of this Privacy Notice:

As the holder of personal data, you may exercise the rights of Access, Rectification, Cancellation, and Opposition before the Data Protection Officer. Likewise, you may revoke, at any time, the consent that you have granted and that is necessary for the processing of your Personal Data, as well as limit the use or disclosure of the same.
The request to exercise the rights must contain and be accompanied by the following information and documents:
– The name and address of the holder or other means to communicate the response to your request.
– The documents proving the identity or, as the case may be, the legal representation of the holder.
– The clear and precise description of the personal data concerning which the holder seeks to exercise any rights.
– Any other element or document that facilitates the location of the personal data and any other document required by the legislation in force at the time the request is submitted.
In case you do not wish to receive emails with updates on the products and services marketed by the Controller Party, as well as reminders regarding compliance with certain obligations that apply to you due to your business activity, you may send your request to the email address of the person in charge of the Processing of Personal Data designated by the Controller Party. The Controller Party will not be obliged to delete your Personal Data when it concerns the following:
– that refer to the parties to a private, social or administrative contract and are necessary for its development and fulfillment;
– they must be processed by legal provision;
– it hinders judicial or administrative proceedings related to tax obligations, the investigation and prosecution of crimes, or the updating of administrative sanctions;
– are necessary to protect the legally protected interests of the holder;
– are necessary to act in the public interest.
VII. Revocation. The holder of the Personal Data may revoke their consent to the processing of Personal Data at any time, and must, solely for such purposes, send a written request to the Person in Charge of the Personal Data, either by courier to the address or email address mentioned in this Privacy Notice.
We will have a maximum period of 20 business days to inform you about the origin of the request and, if it is appropriate, make it effective within fifteen business days from the date on which the response is communicated to the email address you provide us for such purposes.
VIII.
